Apply to build or change a structure over or under a highway

If you need to erect a structure over or under a public highway you need a licence from us. A public highway includes any carriageway, footway, pedestrianised area or verge that is maintainable at public expense.

Structures that need a licence include:

  • balconies
  • canopies
  • private apparatus (eg private telephone cable)
  • basements or cellars

Who can apply for a licence to place a structure over or under the highway

Anyone can apply for it but it is normally the builder owner or developer or contractor.

What licence you will need and how much it costs

Licences over a highway

If you are proposing to build a permanent structure or any part of a structure which will overhang or project over a highway you will need a Section 177 Licence. This licence costs £500 (VAT is not applicable). There may be additional charges for calculation checks.

If you are proposing to place private apparatus over the public highway you will need a Section 178 licence. The cost of this licence £110 (VAT is not applicable).

Licences under a highway

If you are proposing to build a permanent structure or any part of a structure which will go under the highway you will need a Section 179 Licence. The cost for this licence is £500 (VAT is not applicable). There may be additional charges for calculation checks.

What you need to provide with your application

You will need to send us:

  • a plan of the proposed location
  • a description of the apparatus
  • technical drawings 

What happens after you've applied

We will review your application and any documentation submitted. If there are any issues we will contact you for further information.

If we grant your application the details will be recorded and you will be given an exclusive reference code that relates to the licence at the agreed location and for an agreed period.

Tacit consent will not apply

It is in the public interest that we process your application before it can be granted. You should contact us if you have not heard from us within 12 weeks.
